1. About these Terms
These Terms of Service (the “Terms”) govern access to and use of the ORM Trace website, hosted service, APIs, agents, integrations, documentation, AI explanations, and related features (together, the “Service”).
The Service is operated by Oles Riaboi, with an address at Krakow, POLAND (referred to as “ORM Trace”, “we”, “us”, or “our”).
By creating an account, connecting an application, or purchasing a subscription, you agree to these Terms. If you use the Service for an organisation, you confirm that you have authority to bind that organisation, and “you” includes that organisation.
2. Professional use
The Service is intended for companies, software professionals, and other users acting for business or professional purposes. It is not offered for personal, family, or household use. You must be at least 18 years old and legally capable of entering into a binding agreement.
3. Accounts and API keys
You must provide accurate account information and keep access to your Google account and ORM Trace API key secure. You are responsible for activity performed through your account and for configuring which applications may send telemetry.
An API key identifies your account. You must not publish, sell, or share it outside the people and systems authorised to use your account. If you believe a key has been exposed, regenerate or disable it promptly and notify us.
4. The Service
ORM Trace receives ORM and SQL telemetry from applications that you connect. Depending on your configuration, telemetry can include SQL text, normalized SQL, query duration, timestamps, application and environment names, application version, ORM and database-provider information, request or trace identifiers, parameter names and types, and other technical performance metadata.
ORM Trace does not require your database credentials and does not connect directly to your database. Database parameter values are disabled by default. Generated SQL can nevertheless contain inline literals or other confidential information, so you must review your application’s output and configuration before enabling telemetry in a sensitive environment.
Detected issues and AI explanations are diagnostic aids. They can be incomplete or incorrect and do not replace testing, execution-plan analysis, security review, backups, or professional engineering judgment.
5. Plans
The Free plan provides access to the Service with the visibility described on the pricing page. The Full plan provides the complete Service without a product-imposed numerical query limit. Features may depend on supported frameworks, providers, and reasonable technical constraints.
“Unlimited” is subject to fair use. It means that ordinary professional monitoring is not billed per query. It does not permit resale, shared hosting for unrelated organisations, intentional load generation, denial-of-service activity, using ORM Trace as general-purpose storage, or usage that materially threatens the security, availability, or cost of operating the Service.
If usage is unusually high, we will normally contact you and try to agree on a practical solution before restricting it. We may act immediately where necessary to protect the Service, other customers, or third parties.
6. Subscriptions, billing, and taxes
Full is a recurring subscription billed in advance at the price, currency, and billing interval shown before purchase. Stripe processes payments and stores payment-method details; ORM Trace does not store complete card details.
Your subscription renews automatically until cancelled. You authorise Stripe and ORM Trace to charge the applicable subscription fee and taxes at each renewal. Currency conversion or bank fees may be charged separately by Stripe, your bank, or your card issuer.
You can cancel through the Stripe customer portal available from your account. Cancellation takes effect at the end of the paid billing period unless stated otherwise in the portal. Your account can then return to the Free plan. Except where required by law or expressly agreed by us, fees already paid are non-refundable and we do not provide credits for partial billing periods.
We may change future subscription prices by giving reasonable advance notice. A price change applies no earlier than your next renewal after the notice period. You can cancel before the new price takes effect.
7. Your data and responsibilities
You retain all rights in telemetry, SQL, application identifiers, and other content submitted through your account (“Customer Data”). You grant us a limited, non-exclusive right to host, process, transmit, reproduce, and analyse Customer Data only as necessary to provide, secure, maintain, and improve the Service and comply with law.
You are responsible for having all rights, notices, permissions, and lawful bases required to submit Customer Data. Do not intentionally send passwords, authentication tokens, payment-card data, health data, special-category personal data, production secrets, or personal data that is unnecessary for database-performance monitoring.
You are responsible for configuring sampling, parameter capture, access controls, and retention appropriate to your organisation. Additional information about personal-data processing must be provided in our Privacy Policy.
8. AI features
When you request an AI explanation, relevant issue evidence and redacted SQL may be sent to an external AI provider to generate the response. Do not rely on AI output as the sole basis for production, security, financial, legal, or other high-impact decisions.
You remain responsible for reviewing proposed code or SQL changes and testing them safely. We do not guarantee that an explanation identifies every cause, vulnerability, or performance impact.
9. Acceptable use
You must not:
- use the Service unlawfully or infringe another person’s rights;
- access systems, accounts, or telemetry without authorisation;
- probe, scan, attack, overload, or circumvent security or rate limits;
- upload malware or content intended to disrupt the Service;
- reverse engineer the hosted Service except where applicable law expressly permits it;
- resell or make the Service available to unrelated third parties without our written agreement;
- use the Service or its output to build a competing hosted service through automated extraction; or
- misrepresent the origin or ownership of Customer Data.
10. Availability and changes
We aim to keep the Service reliable, but we do not promise uninterrupted or error-free operation unless a separate written service-level agreement says otherwise. Maintenance, provider failures, security events, internet conditions, and preview or beta features can affect availability.
We may improve, add, remove, or replace features. We will give reasonable notice before a material change that substantially reduces the core functionality of a paid plan, where practicable.
11. Intellectual property
ORM Trace and its licensors own the Service, website, hosted software, documentation, branding, and all related intellectual-property rights, excluding Customer Data. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service during your account term.
NuGet packages or other components distributed under a separate licence are governed by that licence. If you provide feedback, you allow us to use it without restriction or payment, but we will not identify you publicly without permission.
12. Confidentiality and security
Each party must use reasonable care to protect non-public information received from the other and use it only for the relationship under these Terms. This obligation does not apply to information that is public through no breach, already lawfully known, independently developed, or lawfully received from another source.
We use reasonable technical and organisational measures designed to protect the Service. No online service is completely secure, and you acknowledge the risks inherent in transmitting and storing information online.
13. Suspension and termination
You may stop using the Service at any time and may cancel a paid subscription as described above. We may suspend or terminate access if you materially breach these Terms, fail to pay, create a security or legal risk, or use the Service in a way that harms other customers or the Service.
Where the issue can reasonably be corrected, we will normally provide notice and an opportunity to correct it. We may suspend immediately for urgent security, fraud, abuse, or legal reasons.
After termination, your right to use the Service ends. We may delete Customer Data after a reasonable account-closure period, subject to backups, audit records, payment records, legal obligations, and legitimate security needs. Export any information you need before closing your account.
14. Warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will detect every issue or produce a particular performance improvement.
15. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profit, revenue, business opportunity, goodwill, or data.
Our total aggregate liability arising from the Service or these Terms is limited to the greater of: (a) the amount you paid to ORM Trace during the 12 months before the event giving rise to the claim; or (b) EUR 100.
These limitations do not apply where liability cannot legally be excluded or limited, including liability caused by wilful misconduct, or other liability that applicable law requires to remain unlimited.
16. Indemnity
You will defend and indemnify ORM Trace against third-party claims, damages, and reasonable costs arising from Customer Data, your unlawful use of the Service, or your material breach of Sections 7 or 9, except to the extent caused by our own breach or misconduct.
17. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. The courts having jurisdiction over our registered office in Poland have exclusive jurisdiction, unless mandatory law requires otherwise.
Before filing a claim, each party agrees to make a reasonable attempt to resolve the dispute by contacting the other party and allowing at least 30 days for a response.
18. Changes to these Terms
We may update these Terms. We will post the updated version and change the effective date. For material changes affecting paid use, we will provide reasonable advance notice through the Service or by email. Continued use after the effective date constitutes acceptance; if you do not agree, you must stop using the Service and cancel before the change takes effect.
19. General
You may not assign these Terms without our consent. We may assign them as part of a reorganisation, financing, merger, acquisition, or transfer of the Service. Neither party is liable for delay caused by events beyond its reasonable control.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. These Terms and any documents expressly incorporated into them are the entire agreement concerning the Service.
